Terms of use
These are the terms on which Bulawayo1872.com is published. The companion documents are the privacy policy, which says what happens to information, and the contribution guidelines, which say what permission to publish a photograph or a memory actually covers.
1. About these terms
These Terms of Use (the “Terms”) govern your access to and use of Bulawayo1872.com (the “Website”), including its articles, photographs, historical records, newsletters and other material. By accessing or using the Website, you agree to these Terms. If you do not agree, please do not use the Website. Specific services or purchases, if introduced, may have additional terms made available before you use or buy them.
2. What Bulawayo1872.com provides
Bulawayo1872.com is an independent publishing and heritage project concerned with Bulawayo, its people, places, history and connections around the world. Material may include archival documents, community memories, interviews, photographs, historical interpretation and contributions from readers.
Unless expressly stated, the Website is not an official publication of the City of Bulawayo, the Government of Zimbabwe or any institution discussed on the Website. Reference to an organisation, school, business or individual does not imply its endorsement of or affiliation with the Website.
3. Historical accuracy, attribution and corrections
We aim to publish in good faith, distinguish documented facts from memories and interpretation where practicable, and acknowledge sources and contributors where known. Historical accounts may be incomplete, disputed or shaped by the perspectives and language of their time. Publication of a historical source does not mean we endorse every view expressed in it.
We may clarify, correct, add context to, update or remove material. If you identify an error, a misattribution, a privacy concern or information that needs context, please contact us with the page address and supporting details. We will review genuine concerns in good faith, but cannot promise a particular editorial outcome or response time.
4. Copyright and permitted use
Except where otherwise identified, the original text, design, organisation and other material created by Bulawayo1872.com are protected by applicable intellectual-property laws. Photographs, documents, quotations and other material supplied by contributors or third parties may remain the property of their respective rights holders. Inclusion in a historical archive does not, by itself, mean that a work is in the public domain or that Bulawayo1872.com owns its copyright.
You may read, share links to, and make reasonable personal, non-commercial use of the Website, subject to applicable law and any rights notices accompanying particular material. You must retain relevant credit and copyright notices. Unless you have permission or a legal exception applies, you may not republish substantial material, sell or license it, use it in merchandise, systematically copy the archive or present it as your own work. Automated collection for dataset building or artificial-intelligence model training is not authorised by these Terms, except where permitted by mandatory law or by our express written permission. Ordinary search-engine indexing that respects published site controls is permitted.
To request permission to reproduce material, please contact us and identify the item, the proposed use and the intended audience. If we do not control the relevant rights, we may refer you to the rights holder where known.
5. Contributions: stories, memories, photographs and documents
We welcome relevant contributions, but sending us material does not require us to publish it. Please do not send material that you are not entitled to share. If you submit material for possible publication, tell us where it came from, who created it (if known), approximately when it was created, how you would like to be credited and whether any privacy or publication restrictions apply.
You retain any copyright or other rights you hold in your contribution. If you expressly authorise us to publish it, you grant Bulawayo1872.com a non-exclusive, worldwide, royalty-free licence to reproduce, display and preserve that contribution on the Website and in related archival communications, including The Bulawayo Letter and reasonable promotion of the relevant archive item. This licence includes necessary technical changes, such as resizing an image, improving readability, formatting text or preparing an accessible version. We will not knowingly make substantive changes to your account that distort its meaning.
This licence does not give us ownership of your contribution or, without a separate agreement, permission to sell it as a print or product, license it independently to third parties, or use it to endorse a sponsor. We may use hosting, email and other service providers to carry out the publication rights described above.
You may ask us to correct a credit, apply an agreed restriction or remove a contribution. We will consider such requests reasonably, taking account of applicable rights, legitimate archival needs and any legal obligations. We cannot control copies already made by third parties or search engines.
6. Your responsibilities when contributing
When you expressly authorise a contribution for publication, you confirm to the best of your knowledge that the information you provide about its source and rights is accurate, and that you own the relevant rights or have permission sufficient for the intended use. Please disclose if a photograph or document was created by someone else, even if you own the physical original.
Do not submit material that unlawfully infringes copyright, breaches confidentiality, exposes private personal information, defames a person, threatens anyone, or otherwise violates applicable law. Please obtain appropriate permission before sending sensitive information about identifiable people, especially children and living individuals. We may decline, edit for lawful publication, restrict or remove contributions where we reasonably consider it necessary.
7. Copyright, privacy and takedown requests
If material on the Website may infringe your rights, expose private information, or incorrectly identify you or another person, contact info@bulawayo1872.com. Please include (where possible) the webpage URL, the specific material, your connection to it, the concern, evidence supporting your request and a reliable way to contact you. Do not send unnecessary sensitive documents.
We may ask for reasonable verification, consult relevant contributors or rights holders, temporarily restrict access while reviewing a concern, and take action we consider appropriate under applicable law. We will not assume that an allegation, by itself, proves a breach. Knowingly misleading notices may be declined.
8. Responsible use of the Website
You must not misuse the Website, attempt unauthorised access, introduce malicious software, interfere with its operation, impersonate another person, harvest personal information, or use its content to harass or unlawfully discriminate against anyone. You must not use automated tools to overload the Website or bypass reasonable access controls. Use by search engines and accessibility tools consistent with their legitimate purposes and our published technical controls is not prohibited.
9. Links and references
You are welcome to link to public pages of Bulawayo1872.com, provided the link does not falsely imply our endorsement or affiliation. If you quote or reference our original work, please identify Bulawayo1872.com and link to the relevant page where reasonably possible. Quoting does not replace the need for permission where the intended use is not otherwise lawful.
10. External websites, advertisers and sponsors
The Website may link to third-party websites, archives, businesses or services. We do not control their content, security, availability or policies. You should review their terms and privacy notices before using them.
We may display advertising, sponsorships, affiliate links or paid listings. We will seek to identify paid commercial relationships clearly. A paid placement is not a guarantee of a product or service, and the views of contributors do not necessarily represent those of advertisers. Transactions with third parties are ordinarily between you and those parties unless we clearly state otherwise.
11. The Bulawayo Letter and other messages
If you subscribe to The Bulawayo Letter, we may email you the updates you request, in accordance with our privacy policy and applicable law. You can unsubscribe from marketing or newsletter messages using the link provided in those emails or by contacting us. Administrative responses to enquiries or rights requests may still be sent where appropriate.
12. Privacy and cookies
Our separate privacy policy explains what personal information we collect, why and how it is processed, which service providers may receive it, any relevant international transfers, how long it may be kept, and how to exercise applicable rights. Any cookie choices or legally required consents will be handled separately from agreement to these Terms. Please read the privacy policy before sending personal or family information.
13. Purchases, transaction-specific terms and supplier disclosures
Reading the Website or subscribing to its free newsletter does not constitute a purchase. We may in future offer books, archival prints, merchandise, paid listings, memberships or other products or services. No order is placed and no payment is due merely by using this Website or reading these Terms.
Who is selling. Each offer will identify whether the seller is numo uno Technologies, operating Bulawayo1872.com, or an independent third-party merchant. Where an external merchant is the actual seller, its own checkout, delivery, cancellation and refund terms govern the sale, subject to applicable law; any referral, affiliate or sponsorship relationship will be disclosed where relevant. We will not represent ourselves as the seller when we are acting only as a publisher or referrer.
Supplier disclosures before direct sales. If numo uno Technologies sells directly by electronic transaction, we will make the legally required supplier details available online where the product or service is offered and before checkout. As applicable, these include the seller’s full legal name and status, physical address, telephone number, website and email, legal-service address, place of registration, registration number and office bearers, relevant memberships or codes of conduct, and information about available dispute-resolution arrangements. Our publishing name or address alone is not a substitute for all legally required supplier particulars.
Transaction details. Before a direct order is submitted, the product or service page and checkout will identify the item’s main features; the price and currency; applicable taxes, delivery fees and any other charges; payment methods; estimated dispatch, delivery or service times; geographical restrictions; applicable guarantees; the return, cancellation, exchange and refund rules; and how the customer can access or retain a record of the transaction. For recurring services, we will also disclose the duration, renewal and cancellation arrangements. Additional product-specific terms will be made available in a form that the customer can access and keep.
Checkout, payment and confirmation. For direct sales, customers will have an opportunity to review the entire order, correct errors or abandon it before finally placing it. Payment will be handled through a suitably secure payment system, and an order confirmation or transaction record will be supplied in accordance with applicable law. An acknowledgement of receipt does not guarantee acceptance or availability unless the checkout terms say otherwise.
Cancellations and mandatory rights. Any applicable statutory cancellation and refund rights, including those under Zimbabwe’s Consumer Protection Act for qualifying electronic transactions, will be honoured. We will not treat goods as automatically non-refundable merely because they are printed on demand or personalised; any lawful exception must be assessed and clearly disclosed for the particular transaction. Where there is a conflict between these Terms and mandatory consumer law, mandatory law prevails.
Separate commercial terms. Direct sales will be governed by the specific offer, checkout disclosures and any published Commercial Terms in force when the transaction is placed. We will not apply new conditions retroactively to completed purchases without a lawful basis.
14. Availability and security
We aim to keep the Website available and reasonably secure, but may change, suspend or discontinue features, correct errors or take the Website offline for maintenance. We cannot guarantee uninterrupted access, permanent availability of every archival item or that all material is free of technical errors. You are responsible for taking sensible precautions when using the internet or downloading files.
15. Information and warranties
The Website is provided for general historical, cultural, educational and informational purposes. We use reasonable editorial care, but do not warrant that all content is complete, current or error-free. In particular, historical memories, dates, names, translations, locations and records may require independent verification before being relied on for important decisions.
To the extent permitted by law, the Website is made available “as is” and “as available”. Nothing in these Terms excludes any warranty, remedy or consumer protection that cannot lawfully be excluded.
16. Limits on liability
To the fullest extent permitted by applicable law, Bulawayo1872.com will not be liable for indirect or consequential losses arising from use of or inability to use the Website, or from reliance on third-party material or services. This clause does not exclude or limit liability where doing so would be unlawful, including for fraud, intentional misconduct, or other liability that applicable law requires us to retain. Your mandatory legal rights are unaffected.
17. Changes to the Website and these Terms
We may update these Terms as the Website develops or legal requirements change. The current version and its last-updated date will be posted here. Material changes will be communicated in a reasonable way where appropriate. Changes apply prospectively from their stated effective date and do not override rights already accrued or transaction terms accepted earlier unless lawfully agreed.
18. Governing law and disputes
These Terms are governed by the laws of Zimbabwe, without prejudice to any mandatory rights you may have under laws that apply to you. Disputes arising from these Terms or use of the Website will be subject to the competent courts of Zimbabwe, except where applicable law provides a different mandatory forum or remedy.
We encourage you to contact us first so that a concern may be resolved informally. Doing so is not a condition of exercising any legal right.
19. General provisions
If a provision of these Terms is found invalid or unenforceable, the remaining provisions continue to apply so far as lawful. A delay in enforcing a provision does not waive our right to enforce it later. These Terms and any applicable additional terms govern use of the Website, subject to mandatory law. Headings are included for convenience only.
